GLAD deplores RI Supreme Court decision blocking couple's divorce
GLAD deplores RI Supreme Court decision blocking couple's divorce
The Rhode Island Supreme Court released a 3-2 decision Friday preventing Cassandra Ormiston and Margaret Chambers from obtaining a divorce.

The women are Rhode Island residents who married in Fall River, Massachusetts in 2004, and mutually sought a divorce in Rhode Island Family Court in October 2006. Family Court Chief Judge Jeremiah S. Jeremiah Jr. asked the Supreme Court to rule on whether his court had jurisdiction to recognize the couple's Massachusetts marriage for the purpose of granting them the divorce. The Court's answer, in today's ruling, was no. GLAD released the following statement:

"We're dismayed on behalf of Ms. Ormiston and Ms. Chambers. Obstacles are being placed before them that other couples don't have to face. As the dissenters recognize, this opinion "places the parties, and all those similarly situated, in an untenable position. They are denied access to the Family Court and thus are left in a virtual legal limbo&"

"We are equally dismayed that Court went out of its way to make an apparent Gay exception to the rule and tradition of respect for valid out-of-state marriages. As a technical matter, this decision is limited to a narrow interpretation of the divorce statute and shouldn't be read more broadly to disrespect the valid marriages of same-sex couples.

"We call all on the legislature to move marriage equality forward, and protect RI's citizens from having to deal with absurd and unfair burdens."

A GLAD press release. The full decision is available at www.glad.org.
