Argentine judge OKs second Gay marriage

A judge in Buenos Aires ruled on February 23 that two men in Argentina's capital may legally marry.

Judge Elena Liberatori said the couple would be exercising their rights even if current laws 'are not in line with the times.'

The couple, whose names were not released, are expected to set a date for their wedding ceremony at the Buenos Aires Civil Registry.

Theirs will be the second same-sex marriage in Argentina and in all of Latin America. Jose Maria di Bello and Alex Freyre were married on December 28 in Argentina's Tierra del Fuego province.

Di Bello and Freyre had also secured judicial approval to marry in Buenos Aires, and Mayor Mauricio Macri promised that his administration would not appeal that decision.

Another judge intervened, however, and issued an injunction preventing their wedding. They ultimately traveled to the remote southern province of Tierra del Fuego, where a sympathetic governor ordered officials to perform the wedding ceremony.

Buenos Aires Mayor Macri is not expected to challenge the February 23 ruling. It remains to be seen whether there will be other court challenges to the wedding.

The only other jurisdiction in Latin America where same-sex marriage is legal is Mexico City, which enacted a marriage equality bill in December 2009. That law becomes effective on March 4 this year.

A bill that would legalize same-sex marriage was introduced in Argentina's Congress in October 2009, but it has stalled without a vote.

Argentina became the first Latin American country to allow same-sex civil unions in 2002. Uruguay also allows same-sex civil unions, as do some states of Mexico and Brazil.

Brazil, Colombia, and Ecuador have same-sex civil union bills pending at the national level.
